DECEMBER 15, 2009

 

 

Chairperson Lu Peet called the Regular Town Board Meeting to order at 6:00PM.  She asked for a motion to go into closed session and read the notice:

The Town Board of the Town of Barnes will meet in regular session to go into a closed session pursuant to State Statute 19.85(c)  “considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility.  The board will reconvene to the regular session immediately after the closed session.

 

Motion ( Webb/Porter) to go into closed session per the above statute.  Roll call vote taken:  all responded yes.  Motion carried.

 

Motion (Meinke/Webb) to adjourn the closed session and return to the open session.  Motion carried.  The Board adjourned the closed session at 6:24PM.  No decisions were made in closed session and discussion was limited to only the statute referenced above.

 

The Open Session was called back to order at 6:30PM.  The Pledge of Allegiance to the Flag was recited. A

roll call to establish a quorum was asked of Chairperson Peet.  All members of the Board were present. Brustad verified the posting of the agenda.

 

Peet asked for a motion to approve the December Agenda, approve minutes of the Last Regular Board Meeting and a motion to dispense with reading of the minutes.

                Approval of Resolution # 09-08 for Town’s obligation over the bond amount to the County Treasurer for collection of taxes                

Chairperson Peet read the Resolution to the members of the Board and audience:

 

RESOLUTION R-09-08

 

WHEREAS, the Town of Barnes Treasurer is required by statute to furnish a bond to the County Treasurer in a sum of double the amount of state and county taxes apportioned to her town, conditioned for the faithful performance of the duties of her office and that she will account for and pay over according to law all state and county taxes which shall come into her hands, and

WHEREAS, the Town of Barnes is given the power under Section 70.67(2) of the Wisconsin Statutes, to obligate the town in case the Town Treasurer shall fail to pay all state and county taxes required by law to be paid by the Town Treasurer to the County Treasurer,

NOW, THEREFORE BE IT RESOLVED by the Board of the Town of Barnes, at its regular meeting held this 15th day of December, 2009, that the Town of Barnes does hereby obligate itself to pay in case the Town Treasurer shall fail to do so, all state and county taxes required by law to be paid by such Treasurer to the County Treasurer.

Motion (McGee/Porter) to approve the voucher’s as presented.  Motion carried.

 

Clerk Correspondence

Brustad said she didn’t have anything to report other than the new Pictometry program the county has offered to the Townships.  They will supply an external hard drive for free to us so we can download the program and use it here at the office.  If we would like the whole county program we will need to purchase a larger hard drive ourselves, but the cost is minimal, only about $80.00-$120.00.  The person she spoke with wasn’t quite sure about the whole program so will be getting back to her.

 

                Appointment of Election workers for the 2010-2011 cycles

Brustad read the list of applicants for selection: Roberta DeLizio, Dorothy Mueller, Polly Beuk, Beverly Lowery, Florence Prickett and Mary Sadenwasser.  These 6 have been election workers in the past and have had recent training.  Alternates will be Susan Wiesner and Linda Frank.  Brustad said she plans on using these two as alternates and will be training them in the future.

 

Motion (Porter/Meinke) to approve the named election workers for the 2010-2011 Election cycles. 

Roll call vote taken:  all responded yes.  Motion carried.

 

During the closed session the Board discussed the new health insurance plans for the employees for the upcoming year. 

Motion (Webb/Porter) to approve using Security Health Plan for the 2010 year and to amend the 2010 budget for the difference in budgeted premium.  Roll call vote taken, all responded yes.  Motion carried.

The second item discussed in closed session pertained to dependant health insurance coverage for Elaine Brustad.  That will be tabled until the next meeting so Brustad can contact Humana about a different policy with a lesser premium amount.

The third item discussed in closed session will be tabled until the fall budget session when they can possibly change the policy for holidays and additional benefits.

 

Department Head Reports:

                Highway

                Just before deer season, found out that the 2 miles of the Hughes Town Line road we maintain had            been torn up by log haulers. We spent 3 days in the northern part of Town getting these roads in      shape for all the hunters that use them.

                We insulated the Town office floor with regular R-29 insulation, and stapled house wrap to the      bottom of the floor joists to cut down on air infiltration. The price quote on spray insulation was 4          times higher than doing it with regular insulation.

                Winter’s here, we have been busy plowing roads with the last two snowfalls. It has been very         difficult to plow gravel and sand roads because of the lack of moisture in the snow. The snow does       not pack hardly at all, and requires us to go very slow or hold the plows up so we do not plow all        the gravel into the ditches.  The ice rink has been flooded and is ready to go.  We hope people use                 it as much as they can as it is costly to maintain, labor wise.

 

                Cemetery             

                There has been no activity as of the last meeting, per Sexton Bud Pease.

 

                Fire and Ambulance Department

                Since the last Town board meeting the ambulance has had 6 calls.

 

                2 - Transport to St. Marys

                1 – No transport

                1 – Facility Transport from Hayward to Home

                1 – Transport to St. Lukes

                1 -  Transport to Ashland

 

                Everything has been finalized for the ECG we are just awaiting the training on sending out to          Hospital. 

                I am also trying to work with Gold Cross on the Ambulance runs.  It seems like all of a sudden they              are charging an enormous amount when we intercept with them and they ride in our ambulance.               The last bill they billed us $1400.00 and in one case after they billed us they turned around and          billed the patient for the same amount so I am trying to work on this. 

                The three EMT’s taking the EMT class in Gordon are nearing the completing and should be           available by the end of January depending on when they take their National Registry test. The                 three who are Irene Wells, Deanna Hughes and Benjamin Gilicki should have their Temporary            licenses with in the next several days. 

                 On the Fire side there is not much to report at this time, there has been no activity to report.  It is   Christmas time and I want to remind everyone to be safe with their lights and Christmas Trees. 

                I am working with the Town of Highland Fire Department.  Because the Murray Lake Dry Hydrant is               no longer a working option we are working to receive grants to purchase and bury a 25,000 gal          water tank in the HWY 27 and Ellison Lake Road Area that would benefit both Fire Departments              and both Townships.

                Also we will be conducting Ice rescue training in January so if you see a bunch of crazy people in yellow suits jumping in the cold water on the Middle Eau Claire it is only is.

 

                                Adopt Ordinance establishing Fire Protection charges

Brustad said Tom Renz had approved the ordinance as she had corrected it.  The Chapter 5 amounts have been copied for the Board to look at but the actual Chapter 5 revision won’t be done until the Board meets at a later date to discuss the ordinances in general.

 

                                Motion ( Webb/Porter) to adopt the Fire Protection Charges Ordinance as                                                      presented.  Motion carried.   The ordinance is as follows:

 

                CHAPTER 3-1-4

ORDINANCE ESTABLISHING FIRE PROTECTION CHARGES

It is hereby ordained by the Town Board of the Town of Barnes, Bayfield County, Wisconsin as follows:

Section 1 – Authority:  This ordinance is adopted pursuant to the authority granted town boards under s. 6055 (2)(b), Wis Statutes which allows towns to recover the cost of fire calls made to property within the town.

 

Section 2 – Liability for Fire Protection Costs:  The Town of Barnes, Bayfield County, Wisconsin, hereby imposes a charge for each fire call made within the limits of the Town of Barnes.  Violation of this ordinance shall be in accordance with the schedule of deposit, which are now in existence and as may be amended from time to time in the future, plus any applicable assessments, costs, fees and penalty enhances now in force in the Bayfield County Circuit Court, or as enforced in the future. Such fee shall not exceed the actual cost to the Town for the fire call.  If the call is to real estate located within the Town, the charges shall be imposed on all owners of real estate to which the particular fire call is made.  In the event that a fire call is not made to real estate located within the Town, but is instead made to personal property, such as a vehicle, the charges provided for under this ordinance shall be imposed on all owners of such personal property.

 

Section 3 – Payment of Fire Call Fee:  The fire call charges provided for in this ordinance shall be paid in full to the Clerk of the Town of Barnes, no later than 60 days after the date of the particular fire call.  The failure to pay the bill within 60 days will result in interest being charged at the rate of 1 ˝ percent per month from the date of the bill.  Those bills for fire calls to real estate, including interest, that remain outstanding for more than 90 days as of November 1st of any year shall become a lien against the real estate and shall be placed on the tax roll as a delinquent special charge under s 66.0627, Wis. Stat.

 

Section 4 – Liability for Fire Calls from Fire Departments Other than Authorized Fire Departments:  Any property owner requesting fire protection directly from any other fire department shall be responsible for the full costs billed to the town resulting from the fire call.  This section shall not apply to the costs of any other department responding at the request of an authorized department under a mutual aid agreement. 

 

Section 5 – Severability:  Should any section or provisions of this ordinance be declared invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. 

 

Section 6 – Effective Date: This ordinance shall become effective upon adoption and publication or posting, as provided by law, pursuant to s 60.80, Wis. Stat.

There were 3 alarms from the sheriff, 1 trespass complaint on Island Lake Rd, 4 firearm complaints, deer hunters too close to occupied structures, 1 welfare check on an overdue hunter who was found safe, 2 animal complaints, dog running at large on Red Oak Drive, 10 check homes for out of town residents.  Total miles 420, total fuel 40 gallons, total hours, 56.

 

Committee Reports

Town Hall Maintenance committee will be meeting sometime this week.

 

                Approval of proposal for new furnace at the Town Hall and amendment of budget for costs

Brustad said she had contacted Arch heating to do a regular maintenance check and while they were here they discovered the furnace would need to be replaced as soon as possible. 

Arch recommends a new Goodman GMH950904CX furnace for replacement.  Improvements will be made to the return air system to help quiet the noise.  Additional installation of a supply ductwork system above the drop ceiling to further reduce noise and provide more even heat.  Total for the above is proposed at $4950.00. 

 

Motion (Porter/McGee) to approve the proposal from Arch Heating for $4,950.00 and amend budget for the same taking the monies out of the maintenance and repair fund.   Discussion followed with Webb asking if the furnace couldn’t be placed in the kitchen somewhere and the ductwork run below the floor in the crawl space.  Brustad will call them in the morning.  Roll call vote taken:  all responded yes.  Motion carried.

 

 

 

Land Use Planning Commission   

Dave Pease said there were no issues to discuss.

 

Public Comment Session – 3 Minute limit for those not on the agenda

No one wished to speak.

 

Citizen’s Request for Action:

 

                Request by Greg Roman for addressing the issue of junk cars, appliances and general up keep of a property’s exterior

Greg Roman spoke as President of the Potawatomi Property Owners association requesting an ordinance with more “meat” to address the issue in the town of unsightly junk vehicles, appliances and general upkeep of exterior property.  A substantial fine should be added for non-compliance.  It seems offenders will clean it up when they have been put on notice about it then let it lapse back into being unsightly again.  It needs to hit these people in the pocketbooks, he felt.  After discussion the Board determined they needed a request for action on a particular property.  The board will then research what ordinances the county or state may have so the town won’t be re-inventing the wheel. 

 

Request by Bud Heerema for approval to place photo gallery of past Chairpersons in the Town Hall

Bud Heerema asked the board for approval to research and obtain pictures of past Chairperson for the town.  The pictures will then be placed as a photo gallery in the town hall or wherever the Board wished.  He thought now would be the best time to do this as there are still relatives living in the area of all the past chairpersons. 

 

Motion (Porter/Webb) to approve having Bud Heerema research and place a photo gallery of past Chairpersons in the town hall.  Motion carried.

 

Approval of letter to Douglas County Highway Department regarding County Highway Y

Chair Lu Peet read the letter that would be sent to the Highway Commissioner and Highway Committee.

 

Motion ( Porter/Meinke) to approve having the Clerk-Treasurer send the letter to the Highway Department of Douglas County regarding County highway Y.  Motion carried.

 

Operator Licenses: 2 Year new License for Kris Nelson        

Brustad said a background check showed 3 arrests and convictions in 2001, 2003, and 2004.  All were misdemeanors but the information was not on the application submitted by Mr. Nelson.  Mr. Nelson also had not completed the beverage server course prior to the meeting.

 

Motion (Porter/McGee) to deny the request for a two year operator license for Kris Nelson based on the applicant not filling out his application fully.  Motion carried. 

 

Discussion of setting up a Special Town Board meeting to look at all ordinances and set new fees for Chapter 5              

Peet felt a Special Town Board meeting was needed for this as it will take quite a while to go through all the ordinances.  The board agreed the meeting will be held on February 11th at 5:00PM. 

               

Issues Timeline Update

All issues are a work in progress, no new updates other than the furnace at the town hall.
